INTRODUCTION

This Privacy Policy is incorporated into the Primrose Place Terms of Service by reference.  All capitalized terms used in this Privacy Policy shall be given the same meaning ascribed to such terms as set forth in the Terms of Service, unless certain capitalized terms herein do not appear in the Terms of Service, in which case they will be ascribed a meaning in this Privacy Policy.  The Terms of Service and this Privacy Policy both apply to your access to and use of the Site, and your utilization of the Services.  Therefore, please read the Terms of Service and this Privacy Policy carefully before accessing or using the Site, or utilizing the Services.

Primrose Place respects the privacy of the users of its Site and Services.  This Privacy Policy defines what information We collect and how and when We collect, use, and share the information you provide by accessing or using this Site and/or utilizing the Services.  By accessing or using the Site, or utilizing the Services, you agree to be bound by the terms of this Privacy Policy, and consent to the collection, maintenance, and use of your information in accordance with the terms of this Privacy Policy.  If you do not agree to the terms of this Privacy Policy, please do not access or use the Site, utilize the Services, or provide any material, content, or personal information to Us.

Primrose Place reserves the right, and may, at Our sole discretion, modify or update any aspect of this Privacy Policy at any time.  If We do so, We will post the updated Privacy Policy to the Site and note the date the changes went into effect.  Any modified or updated Privacy Policy is effective upon its posting to the Site.  Your continued access to or use of the Site or utilization of the Services after such posting constitutes your acceptance to the modified and/or updated Privacy Policy.  It is your responsibility to regularly review the Privacy Policy to determine whether any modifications or updates have been made.  Please note that the collection, use, and sharing of your information as described in this Privacy Policy by Primrose Place will also extend to Our directors, officers, shareholders, employees, contractors, agents, representatives, and affiliates (collectively “Affiliates”).

CHILDREN UNDER AGE 13, 18

Children under thirteen (13) years of age should not access or use the Site or utilize the Services.  We do not knowingly collect personally identifiable information from children under the age of 13.  If We become aware that a user is under the age of 13, we will remove their personally identifiable information from our records.

Children under eighteen (18) years of age should obtain consent from their parents or guardians before sending any information about themselves to anyone over the Internet, including on or through this Site.  In fact, per the Terms of Service, children under the age of 18 are prohibited from creating a user account with Us or making purchases from Us.  When a child between the ages of 13 and 18 uses the Site, the parent or guardian of that minor will be held responsible for the minor’s actions and will be deemed to have consented to the collection, use, and sharing of the minor’s information by Primrose Place.

HOW WE COLLECT INFORMATION

In general, Primrose Place collects personally identifiable information and non-personally identifiable information that users voluntarily provide to Primrose Place when accessing and using the Site or utilizing the Services.  We also collect information related to your use of the Site as you interact with the Site.

WHAT INFORMATION WE COLLECT AND HOW IT IS USED

User Account Information

Before receiving the Services or making any payments, you must create a password protected individual user account in which you must provide the following personal and non-personal information: (i) name; (ii) user name; (iii) password; and (iv) email address.  It is your sole responsibility to maintain and safeguard your user name and password, and to otherwise prevent the unauthorized access to or use of your user account by others via your unique user name and password.  Primrose Place assumes no responsibility for doing so,  We may, but are not obligated to, store your user name and password in the event, for example, you become locked-out of your user account and require such information to regain access.  Other than to its Affiliates who have a need to know such information to support the operation of the Site or to assist in providing the Services, Primrose Place will not share your user name and password with others without first obtaining your permission to do so.

Also, your name, user name, and email address may be used by Primrose Place to communicate with you regarding the Site, the Services, and to report any updates thereto or announcements therefor, as well as for requesting feedback from you regarding your experience with the Site and the Services.  Your name, user name, and email address may further be used by Primrose Place for marketing purposes, such as informing you of Our other products and services and sharing content from the Site and other information with you.  Other than to Our Affiliates who have a need to know such information to support the operation of the Website or to assist in providing the Services, Primrose Place will not share your name, user name, or email address with others without first obtaining your permission to do so.

Additionally, you may be asked to provide your gender, age, race/ethnicity when creating a user account.  Providing this information is optional, and is being requested and collected so that Primrose Place may better understand the demographics of the users of its Site and the recipients of its Services.  That information may be used by Primrose Place to improve or modify the Site, the Services, Our other products and services, for marketing purposes (including those purposes mentioned elsewhere in this Privacy Policy), and for other internal business purposes.  Other than to Primrose Place’s Affiliates who have a need to know such information to support the operation of the Site or to assist in providing the Services, Primrose Place will not share such demographic information without first obtaining your permission to do so.

Payment Information

Information you supply to make a purchase on or through the Site, including, without limitation, name, address, and credit card or other payment information, is processed through a third party payment service provider, and is not typically stored or processed on Primrose Place’s servers.  You should review the terms and conditions and privacy practices of such third party payment service provider, which can be found at https://www.paypal.com/webapps/mpp/ua/privacy-full to better understand how such information is being collected, stored, and used.  Primrose Place is not responsible, and shall not be liable, for the collection, storage, and use of such information by such third party payment service provider.

User Content

When accessing and using the Site, and utilizing the Services, you may provide or submit User Content, which may contain personally identifiable as well as non-personally identifiable information.  We may collect, store, and use User Content as set forth in the Terms of Service.  Your User Content may become available to the public.  Therefore, please exercise caution before providing, submitting, or using User Content.  Your provision, submission, and use of User Content is done at your own risk, and Primrose Place is not liable therefor.

Site Use Information

Primrose Place monitors and tracks when you log-in to your user account, and collects such information.  When accessing or using the Site, or receiving the Services, Primrose Place also collects non-personally identifiable information obtained therefrom, possibly including, without limitation, your browser type, operating system, domain names, and IP addresses.  We use different types of technologies to collect such information.  In addition, we store certain information from your browser using “cookies” or similar technology.  A “cookie” is a piece of data stored on the user’s computer tied to information about the user.  We use session ID cookies to confirm that users are logged in.  These cookies terminate when the user closes the browser.  Under other circumstances, including if you select the “Remember Me” option upon login, we use a persistent cookie, for example, to store your log-in information to allow you to automatically login when you revisit the Site.  You can set your browser to refuse cookies; however, if you do so, some or all of the Site or the Services may not function properly or at all.

Primrose Place may use such information to understand how users interact with the Site and the Services in order to improve or modify the Site, the Services, Our other products and services, for marketing purposes (including those mentioned elsewhere in this Privacy Policy), and for other internal business purposes.  Other than to Primrose Place’s Affiliates who have a need to know such information to support the operation of the Site or to assist in providing the Services, Primrose Place will not share such information with others without first obtaining your permission to do so.

Feedback

After accessing or using the Site, or receiving the Services, Primrose Place may send you, via email or otherwise, a request for your voluntary feedback.  You may also voluntarily submit feedback to Primrose Place via email or otherwise without prompting.  Such information, including your email address and the feedback you provide to Us, may be stored and used by Primrose Place to improve or modify the Site, the Services, Our other products and services, and for other internal business purposes.  We may also share the feedback you provide to Us with others for the purposes of promoting the Site and the Services, and to solicit and obtain endorsements for the Site and the Services.  However, when doing so, such feedback will be de-identified (i.e., disassociated with any personally identifiable information) and possibly aggregated with feedback provided by, or data collected from, other users.

NOTICE FOR CALIFORNIA USERS

California Civil Code Section 1798.83, also known as S.B. 27, allows individual users who have provided or submitted their personal information to Us to request information about our disclosure of certain categories of personal information to third parties for their direct marketing purposes.  Such requests must be submitted to Us in writing to 381 E. Main Street, Lexington, KY 40507.  Within thirty (30) days of receiving such a request, We will provide a list of the categories of personal information We disclosed to third parties for third party direct marketing purposes during the immediately preceding year, along with the names and addresses of those third parties.  This request may be made no more than once per calendar year.  We reserve the right not to respond to requests submitted in ways other than those specified above.

INFORMATION STORAGE AND SECURITY

The Site and all information We collect is stored and processed in the United States.  Primrose Place uses physical, electronic, and administrative security procedures and practices to protect any personal information that We maintain from unauthorized access, use, or disclosure.

Although We strive to protect users’ personal information, there are security and privacy limitations that are beyond Our control.  Moreover, no precautions are completely effective.  Any information provided or submitted to Primrose Place is done so at your own risk.  We cannot guarantee the security of Our database or of any information provided or submitted to, or collected by, Us.

EXTERNAL LINKS

The Site may contain links to other websites not operated or controlled by Primrose Place.  Once you leave the Site, use of any information you provide on another website is not governed by this Privacy Policy.  We encourage you to read the privacy statements of each and every website that you visit which collects personal information.  Primrose Place is not responsible, and shall not be liable, for the privacy practices or the content of such other websites.

BUSINESS TRANSFERS

Notwithstanding the other provisions of this Privacy Policy, in the event all or a portion of Primrose Place’s business is sold to, acquired by, or merged with another entity or business, your information may be transferred to such other entity or business as part of such business transaction.

LEGAL MATTERS

Notwithstanding the other provisions of this Privacy Policy, Primrose Place may disclose information about you if We have a good faith belief that such disclosure is necessary in order to: (i) protect and defendant the rights, property, or safety of Primrose Place, other visitors to the Site, or the public; (b) enforce the Terms of Service, or (c) respond to claims that such information violates or infringes upon the rights of another, whether such rights are afford by law, by contract, in equity, or otherwise. Primrose Place may also disclose information as We deem necessary to satisfy or comply with any applicable law, regulation, rule, governmental order, or legal process.

CLASS ACTION WAIVER

ANY DISPUTE RESOLUTION PROCEEDINGS, WHETHER IN ARBITRATION OR COURT, WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS OR REPRESENTATIVE ACTION OR AS A NAMED OR UNNAMED MEMBER IN A CLASS, CONSOLIDATED, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL LEGAL ACTION.  YOUR ACCESS AND CONTINUED USE OF THE SITE OR UTILIZATION OF THE SERVICE INDICATES YOUR EXPRESS CONSENT TO THIS WAIVER.
